It’s important to note that foreign citizens cannot own land, so when buying a villa or standalone house, the land portion is typically registered as a long-term lease
In Thailand, there are two common forms of property ownership, which are also widely recognized worldwide:
Freehold (also known as Chanote) – this grants full and unrestricted rights to own, use, sell, and inherit the property. It is confirmed by an official document known as ‘chanote’.
Leasehold – this is a form of long-term lease that can last up to 90 years. Despite the temporary nature of ownership, leasehold properties can be sold, rented out, passed on through inheritance, and managed throughout the lease term. The lease agreement is registered and authenticated by the Thailand Land Department
After selecting a property, the process of acquiring real estate involves four stages:
- Signing a reservation agreement and making a deposit. The deposit confirms the buyer’s intentions and serves as insurance for the developer in case the buyer backs out.
